Terms and conditions for using Star Medical Wellness services and website

Welcome to Star Medical Wellness. By accessing or using our services, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our services.

1. Acceptance of Terms

By scheduling an appointment, using our website, or receiving services from Star Medical Wellness, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service and our Privacy Policy. These terms constitute a legally binding agreement between you and Star Medical Wellness.

2. Services Provided

Star Medical Wellness offers the following services:

  • Functional Medicine Consultations: Comprehensive health assessments, root cause analysis, and personalized treatment plans
  • Regenerative Aesthetic Treatments: Advanced aesthetic procedures including PRP, PRF, microneedling, and other regenerative therapies
  • Medical Skincare: Professional skincare treatments addressing skin conditions from a functional perspective
  • Lab Testing Coordination: Advanced laboratory testing through LabCorp and specialty labs
  • Telehealth Appointments: Virtual consultations via secure video conferencing for eligible patients
  • Supplement and Skincare Recommendations: Professional-grade products through our partners

3. Patient Responsibilities

As a patient of Star Medical Wellness, you agree to:

  • Provide Accurate Information: Supply complete and accurate health history, current medications, allergies, and other relevant medical information
  • Update Changes: Promptly inform us of any changes to your health status, medications, or contact information
  • Attend Scheduled Appointments: Arrive on time for appointments or provide adequate notice of cancellation
  • Follow Treatment Plans: Adhere to prescribed treatment plans, recommendations, and follow-up instructions
  • Pay for Services: Pay for services in accordance with our payment policies
  • Account Security: Maintain confidentiality of your patient portal login credentials and notify us immediately of any unauthorized access
  • Communicate Openly: Ask questions and communicate concerns about your treatment

Important Notice

Medical Emergencies: Our services are not appropriate for medical emergencies. If you are experiencing a medical emergency, call 911 immediately or go to your nearest emergency room. Do not use email, patient portals, or our contact forms for urgent medical issues.

4. Cancellation and No-Show Policy

Appointment Cancellations

  • 24-Hour Notice Required: We require at least 24 hours' advance notice to cancel or reschedule an appointment
  • Late Cancellation Fee: Appointments cancelled with less than 24 hours' notice may be subject to a cancellation fee equal to 50% of the appointment cost
  • No-Show Fee: Patients who miss appointments without providing any notice will be charged the full appointment fee
  • Multiple No-Shows: Repeated no-shows or late cancellations may result in a requirement to prepay for future appointments or termination of the patient-provider relationship

Lab Testing Packages

  • Lab testing packages ($197 each) are non-refundable once tests have been ordered through the laboratory
  • Cancellations requested before lab orders are placed may receive a full refund minus a $25 administrative fee
  • You are responsible for scheduling and attending your lab draw appointment at LabCorp

5. Telehealth Consent and Terms

Telehealth Agreement

By participating in telehealth appointments, you acknowledge and agree to the following:

  • Consent to Telehealth: You consent to receive healthcare services via secure video conferencing technology
  • Limitations: Telehealth has limitations compared to in-person visits, including the inability to perform physical examinations or certain diagnostic tests
  • Technical Requirements: You are responsible for having appropriate technology (computer/smartphone, internet connection, camera, microphone) and a private location for appointments
  • Privacy Responsibility: You must ensure you are in a private, secure environment during telehealth consultations
  • Technical Difficulties: Technical problems may occur, potentially requiring rescheduling or conversion to phone consultation
  • Emergency Limitations: Telehealth is not appropriate for medical emergencies
  • State Licensing: Services are provided in accordance with Florida licensure laws. Interstate telehealth may be limited by regulations

6. Payment Terms

Payment Policies

  • Payment Due at Time of Service: Payment is required at the time services are rendered unless alternative arrangements have been made in advance
  • Accepted Payment Methods: We accept major credit cards, debit cards, HSA cards, and FSA cards
  • Lab Packages: Lab testing packages must be paid in full before tests are ordered through the laboratory
  • Product Purchases: Skincare products and supplements purchased through our partner platforms (Regimen Pro, Fullscript) are governed by their respective payment terms

Insurance

  • Star Medical Wellness does not bill insurance companies directly
  • We can provide you with a superbill (detailed receipt) that you may submit to your insurance company for potential reimbursement
  • Insurance coverage and reimbursement are between you and your insurance company
  • You are financially responsible for all services regardless of insurance coverage

Refund Policy

  • Services rendered are generally non-refundable
  • Product refunds are subject to the policies of the respective vendors (Regimen Pro, Fullscript)
  • Refund requests will be considered on a case-by-case basis at our discretion

7. Disclaimer of Warranties

Services and information provided by Star Medical Wellness are offered "as is" without warranties of any kind, either express or implied. While we strive to provide the highest quality care, we do not guarantee specific health outcomes or results. Individual results may vary based on numerous factors including but not limited to:

  • Individual health status and medical history
  • Genetic factors
  • Lifestyle choices and compliance with treatment plans
  • Environmental factors
  • Age and overall health

8. Limitation of Liability

To the fullest extent permitted by law, Star Medical Wellness, its practitioners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from:

  • Use of our services or website
  • Inability to use our services
  • Errors or omissions in website content
  • Delays in treatment or communication
  • Technical failures or interruptions

This limitation applies regardless of the legal theory upon which any such damages are based.

9. Intellectual Property

All content on the Star Medical Wellness website, including but not limited to text, graphics, logos, images, photographs, videos, and software, is the property of Star Medical Wellness and is protected by United States and international copyright laws. You may not:

  • Use our logos, trademarks, or branding without authorization
  • Copy or republish website content for commercial purposes

10. User Conduct

  • Regimen Pro (skincare products)
  • Fullscript (supplement dispensary)
  • Setmore (appointment scheduling)
  • LabCorp (laboratory services)

We are not responsible for the content, privacy practices, or terms of service of these third-party providers. Your use of third-party services is governed by their respective terms and policies.

12. Modifications to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting to our website. We will update the "Last Updated" date at the top of this page. Your continued use of our services after changes are posted constitutes acceptance of the modified terms. We encourage you to review these terms periodically.

13. Termination

We reserve the right to terminate or suspend access to our services at any time, with or without notice, for conduct that we believe:

  • Violates these Terms of Service
  • Is harmful to other patients, staff, or the practice
  • Creates liability or legal risk
  • Is otherwise inappropriate

Patients may terminate the relationship at any time by providing written notice. Outstanding balances must be paid regardless of termination.

14. Governing Law and Jurisdiction

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Florida, without regard to its conflict of law provisions. Any legal action or proceeding arising under these terms shall be brought exclusively in the courts of Seminole County, Florida, and you consent to the jurisdiction of such courts.

15. Severability

If any provision of these Terms of Service is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.

16. Entire Agreement

These Terms of Service, together with our Privacy Policy, Medical Disclaimer, and HIPAA Notice of Privacy Practices, constitute the entire agreement between you and Star Medical Wellness regarding use of our services and supersede all prior agreements and understandings.
